How to determine if your business is affected

Ask yourself the following questions:

  1. Are you a medium to large businesses in the private sector?
  2. Do any of your contractors work through a PSC or limited company?
  3. Do you employ workers via a third party such as a recruitment agency?
  4. Do any of your contractors provide services through an intermediary?

If you answered ‘yes’ to any or all of the above, it’s time to act. You must decide on your worker’s status  and inform them of your decision before 6 April 2020. 

NB: Private sector businesses include third sector organisations. Unaffected parties include small businesses and those in the public sector (the IR35 rules have not changed since April 2017).

Small Business Exemption

If you answered ‘no’ to most of the questions above, your business might be exempt. To be considered a ‘small business’ you must also meet two of the following criteria:

  • Turnover is £10m or under
  • Your balance sheet shows £5m or less
  • You employ 50 people or less
